Legal Question in Immigration Law in Pennsylvania

US citizen married to a foreign citizen in the USA

I am a US citizen, married to a British citizen,

for almost 2 years now. We were married here in the USA. However, he entered the USA legally

without a visa, as a tourist in 1994, and stayed

here in the USA without notifying INS.

He has been here 5 years now.

What can we do about legalizing his status?

We do not know what forms to file. Please help.

You can file an I-130 and I-485 with supporting documents at your district ins office. The forms can be obtained at the district office. Tell them you want an I-130/I-485 packet the packet will provide you with all the needed forms as well as instructions for filing. It is possible to complete and file the forms yourself. You might consider seeking the assistance of an immigration attorney in your local area. If you hire an attorney, try and find one who is a member of AILA - American Immigration Lawyers Association.
