Legal Question in Personal Injury in Pennsylvania

Accident

I jumped in front of my car to stop it from hitting the neighbors house. I was having my car towed when it came loose from the tow truck and was heading towards the neighbors porch I jumped in front of it to stop it from hitting the neighbors house stupid I know. I was pinned between the house and car and couldn't breath and the tow truck driver pulled the car off me so I could breath. I was taken away in ambulance and had my spleen removed due to internal bleeding. I guess my question is am I at fault since I jumped in front of the car?

Re: Accident

I think you answered your own question when you wrote, "stupid I know". You may have a claim against the tow truck operator, but then the question is whether your negligence is greater than his. If it is, you can't win. In any event, your medical bills should be paid for by your auto insurance company, regardless of whose fault it was.

Re: Accident

Definitely not your fault. The tow driver likely was negligent in securing the vehicle. Call our offices as soon as possible to discuss your recovery.
