Slip and Fall

On Monday March 10, 2003, I dropped my boyfriend off at a friend of ours apartment complex. Walking up to the door, he slipped on a thick patch of ice. He then turned around to look towards me and slipped again, both times landing flat on his back. Needless to say, his back is not so well. The next day I took him to Montgomery Countu ER in Norristown, PA. They gave him a pain killer shot and sent him home(which I think he is getting a rash from now). He can do things, lie down flat or stand straight up. Sitting presents a huge problem cause it hurts to much to bend his back. Getting up from a laying down position also seems to cause a muscle spasm which almost always knocks him back down to the ground. This same thing happens getting out of a car as well. He has pretty much not been able to do anything for four days now. He will have so far missed almost a week, will be a work week tomorrow, of a brand new job, I probably will take him back to the ER and I don't know if they will run an MRI or what, so those expenses. Does he have any rights here to bring suit against the complex? Email is the best way to reach me. Thank you.

Generally speaking, an owner of real estate does have a duty to keep sidewalks on the property clear of hazardous conditions, in this case, ice.

It would seem that under the facts you describe, your boyfriend has a valid claim against the owner of the apartment complex. It is essential that he continue to obtain follow-up medical care so long as he continues to be in pain.
