Uninsured motorist

I need to know what my rights are. I was involved in

an accident in which the other driver was at fault.

The other driver's insurance company told me they were

canceled because of non payment. There insurance was

canceled 3 days before the accident. The damage to my

car is less than my deductible. What can I

Talk to your insurance company about your deductible for an uninsured motorist claim in case it is less than your deductible for a collision loss. If your company will pay the claim, it then will pursue a subrogation claim directly against the other driver. If your deductible is higher than the amount of the damage, you are stuck initially with paying for the repair. If you can't work something out with the other driver, you can file a small claims lawsuit (in Municipal Court if in Philadelphia, in your local District Justice Court if elsewhere in Pa.)
