The title to the property is the relevant document meaning the deed. Unless the deed is held joint with another person the wife would probably have an interest in the property. This could depend on whether there is a will or if no will if there are children. . A wife also has an intestate share a right to take against a will if she is not left sufficient assets in the will but again the facts of the matter and how the property is titled is relevant. I would advise you speak to an attorney to discuss your situation.
