If the home is in the husband's name alone he is free to leave the home to whomever he wants. The woman's protection would be if the husband has a will and leaves the home to her. Of course she would have some rights in the estate of a husband as a wife but this would involve making an election against the estate in certain circumstances. The best thing to do is obviously have the home place in both names or at least have the husband leave it to the wife by will.
