Hostile Work Environment

How severe, how often, and with how many people does an individual need to sexually harass, which has now led to a hostile work environment, before an employer should terminate that persons employment? One of the complaining females is now being forced to work on the same shift as him. We all feel our safety is in question because he is sexually aggressive and angers very easily. We work at a nuclear power plant and carry firearms. We plan to follow through with an EEOC complaint.

You asked about sexual harassment.

This is a basic civil rights question and no one needs to deal with any type of discriminatory harassment. Every complaint should be acted on. Depending on the investigation some complaints may warrant no action but even then the complaining party should be told so. On occasion some acts just may be what I call "stupid guy tricks." We're dumb, and we make mistakes. But when a mistake is brought to our attention we should correct it and apologize if necessary. Businesses are required to have policies in place regarding this issue among many others.

A person who feels they have been sexually harassed does not need to tolerate it at all generally. There have been some exceptions in VERY NARROW circumstances (such as comedy writers making rude and crude jokes, that's what they are paid to do).

If a formal complaint has been made to the corporate compliance department then it is time to act. Claims made under civil rights laws have very tight time limits. Failure to make a claim promptly may result in the claim being denied.
