Can a 12 year old male student, while in class give sexually explicit drawing to a fellow 12 year old female student?

Is this sexual harassment?

Both principal and acting superintendent of schools say no.

You asked about sexual harassment by a pre-teen.

In a strict sense the conduct could be considered sexual harassment. But if that charge is leveled then it would become a long drawn-out matter and the offending child would have a rather nasty mark on his school record.

Children are children, and much conduct that would be unacceptable amongst adults must be used as a teaching tool with children.

As long as the parties learned that the conduct was inappropriate, and that further such conduct would be dealt with more harshly, then I think the school adminsitrators should have the last word.
