Legal Question in Sexual Harassment in Pennsylvania

co worker having affair with boss

i was the office manager and medical biller ,the boss was having a affair with the xray tech and they accused me of telling the accountant and other physicians of the affair . she was always very hostile towards me and the other employees. they told me i was downsized and left me go . i found out she was to takeover part of my job.

You asked about being downsized so the boss's "girlfriend" could have your job.

Unfortunately the law is very clear against you in this matter. It is discrimination to use a position of power to sexually harass or to obtain sexual favors from another person. It is not sexual harassment to fire another person for the benefit of a person with whom one is having a relationship.

I agree your situation sucks, but then, at least your former employer won't dare contest your claim for unemployment compensation. Good luck, and think yourself better off not working for such an employer.

Discrimination is where a party acts against the interest of a member of a protected class because of their membership in that class. Harassment is where adverse conduct is based (or tolerated) on an unequal power relationship in the parties.
