Legal Question in Wills and Trusts in Pennsylvania

joint bank account

My Mother put my brothers name on her checking account before she died 1/16/2003. He is executor to her will..which states we are to split all her assets. Do I need to find out the exact nature of his position on her account. Does he then inherit all the mnoney in the account and avoid probabte? He has already told me the account will not be counted as oart of her estate and half the money in the account is his. What do I need to do? Thank You
