global mediation

what is the nuts bolts about global mediation when there also exists a civil action case, what actions transpire? what if liability lawyers disagree on amount, can there be separate resolutions?

Global mediation generally means that the entire case and all issues are discussed with a mediator who resolves the dispute by getting the parties to agree to a solution through compromise. For example in a divorce case the mediator would discuss custody, visitation, support, distribution of marital assets, alimony, and any other matters which help the parties arrive at a resolution that satisfies both parties.

The advantage of global mediation is that the mediator and the parties can make trade-offs that the court will not consider but which might help the parties to agree. For example the court does not tie custody and visitation to support but often a father is willing to pay more in child support if he has access to his children. In a business situation, preservation of good will and a continued relationship may be more important than the amount of money in a controversy.
