When is a worker being paid as a sub contractor for one company not a sub and should be on the payroll

Your question raises many issues. There is a concept known as the "borrowed servant" where an emplyee from one company is considered an employee of another for puposes of WC. There are also different circumstances where the irs considers someone to be an employee rather than an independnet contractor. Generally, each case is dependent on its own individual facts howevr, the overiding concept is, who controls the means and methods of the work being done.
