Legal Question in Immigration Law in Philippines

about the processing of H-4 visa

My husband is an H-1B visa holder and he is planning to get me through an H-4 visa. He is gonna be back in our native country on the 3rd week of December, 2006. He has only a 3 weeks vacation and upon this vacation we are going to process my H-4 visa.

My questions are:

1. How long it will take the processing of my H-4 visa?

2. Will it be processed in 3 weeks time?

3. Do we (my husband and I)both have an interview with the Consulate regarding my H-4 visa or it is just my husband who is an H-1B visa holder has to have an interview?

Re: about the processing of H-4 visa

The processing of your H-4 visa can be done within the three week period stay of your husband. This is on the assumption that you have the complete documents that will be required of you by the United States Embassy. You must call the embassy as soon as possible and request an interview date.

You are the one who will be interviewed at the United States Embassy and not your husband.

The presence of your husband during your interview is not indispensable but might be helpful.

Very truly yours,

Re: about the processing of H-4 visa

Processing of visa may take a while. There is a need for physical presence inthe interview. During the pendency of the application, the visa applicant may however stay in the country for as long as 'grace period' application is likewise made.
