Legal Question in Family Law in Rhode Island

can he do this?

I am tryin to help my friend with the following...

she has been with the same man for 7 years...NEVER married..never was seen in community as a "married couple" or anything like that...now...she has inherited money from her grandmother that recently passed away..and he has threatened to take her to court to take 1/2 of this..( they recently broke up)

should she be concerned that he may be able to do this?

I am only licensed in Montana and cannot give specific advice. You will need to contact an attorney in your jurisdiction for more advice.

If your state recognizes common law marriages (not many do) he may be thinking he has a claim on that basis. I would think the timing of the inheritance and the timing of the breakup would be relevant information that your friend should tell her attorney. She needs to consult with an attorney familiar with family law in her state.
