Legal Question in Personal Injury in Rhode Island

my 81 year old grandmother

my grandmother injured her hip in a fall at home. she was diagnosed with a bruise after xrays at the hospital. she fell at the hospital that night and broke her hip.(same hip)she needed surgery and was sent to a nursing home for rehab. she fell there after a couple weeks of rehab and broke her shoulder. a few weeks later after 56 days of rehab she is told she has plateaued in her treatment and taken off of short term care paid by medicare and now a long term patient applying for medicaid. prospect of losing all savings for injuries that occured in the hospital and a nursing home does not seem right to me. all preventive measures to keep a confused overmedicated lady from falling seem to occur after she falls. now she is confined as a captive in her wheel chair with no rehab in her future. i was curious if anything can be done legally to hold those places responsible financially. i hate to see this nursing home get all her cash. thank you for your time.

I'm very sorry to hear about your grandmother's difficulties. It is possible that the hospital could bear some liability, but more information, particularly medical records from her physicians and the hospital charts, etc., would be required to determine whether it would be worth filing a claim against the hospital. If it could be shown that the recovery time and prognosis for a mere bruise would have been much shorter than the time and treatment she now has to face because the hip was broken from inadequate care/supervision in the hospital, there could be financial liability on the part of the hospital and/or nursing home.
