i have been talking to this guy online and on the phone he is from sc i am from mi he no longer has his computer he had given it to his wife with whom he was seperated from and to make a long story short she is sending messages threating to supeona into court to fight the issues between her and him and fighting for adultery on messages sent thru the computer. she is looking to send him to jail and has criminal domestic charges against him just to prove a point to him that she will win this fight between them after finding that there were issues between them i stopped talking to him not to get involved and she just won't leave me or the other he had talked to alone is there anything that i can do or is she the 1 that has right to supeona someone to court that has never met him or her on grounds of adultery with what she has from messages in his archive which she changed the password on his friends list and was able to get in and he isn't able to.

Subpoena issues are very tricky. Most likely she would have to ask the court in your jurisdiction to subpoena you for a deposition. You, of course, would have an absolute right to assert your fifth amendment right against self-incrimination, but you'd have to show up to do it.

I doubt she will subpoena you, however. It costs a lot of money in terms of legal fees.
