Legal Question in Credit and Debt Law in South Carolina

I have a car loan with wells Fargo and a checking account with wachovia. These banks are about to merge. If i had to give my car back can they start taking my paycheck or freeze my account?

Yes, they can. While in general a creditor cannot garnish wages in South Carolina and by extension bank accounts, the exception is if there is a contact which allows it. I am sure that if you read your contracts with Wells Fargo and Wachovia this is allowed. If you cannot pay on your car move your money to another bank.
