Legal Question in Criminal Law in South Carolina

Used cell phone w/out permission

I have a 10 yr old son who visits his father. His father refuses to let him call me on his home phone, (as ordered) so I bought a cell phone for him to use when he's there to call me. (it's not long distance)

My ex stole the phone from my son last week and sent me 2 harassing text messages. One, he pretended to be out son. This is not the first time he's used the phone. I have never given him permission nor has our son.

Is there anything I can do? Isn't it a crime to use a phone without permisison?

If he is in violation of a court order, then you should consult with a Family Court attorney who can review the order and explain your options. There are possibilites that I cannot explain in this answer without seeing the order
