Re: Criminal sexual conduct and kidnapping

It is. But there is more to it. First Degree Criminal Sexual Conduct can be based on a number of possible elements and kidnapping is one of them. It can also be based on there being a sexual battery during a robbery, extortion, housebreaking, burglary, etc. In addition to these, it can be based on there being a sexual battery after the victim was rendered mentally or physically incapacitated by drugs or alcohol, given to the victim by the defendant.
