Post Conviction Relief

1. How can someone who has accepted a plea obtain their court transcripts in order to file for a post conviction relief?

2. Would it be in a persons best interest to obtain an attorney to file for a PRC?

Court transcripts can be obtained from the Court Reporter that was present on the day of the plea. The Clerk of Court could probably obtain the person's name and number. Also knowing the name of the sentencing judge could help. As far as needing an attorney for a PCR, yes. A PCR is a legal action that requires going though a legal process including a hearing in a court of law. It is subject to the Rules of Civil Procedure, Rules of Evidence, Statutory Law, Case Law, etc. It would be extremely unwise to proceed without an attorney.
