child custody

If I were to get separated or divorced, can I move from the state of South Carolina with my daughter before custody is decided?

Re: child custody

You can try to move away, but there is a good chance that the Court would require the child to remain in SC until custody has been decided. Of course, if there is an overwhelming, legitimate reason for you to move, then the Court may allow the child to move before the case is concluded. These cases tend to be very fact-specific, so it's difficult to give any advice without knowing all the pertinent facts.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case. If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
