Legal Question in Family Law in South Carolina

Child Support

I am getting married within the next month, and I was out of work for seven months. I am paying 206.54 a week and with me starting over I make $9.30hr. I was paying child support directly to her when the children were in daycare but the twins are 8 and my oldest son is 11, if she toke me back to court would the judge base the child support on both of our incomes or just mine. Also during the time I was unemployed I picked the kids up from school and fed them dinner everyday during that time.

Re: Child Support

If she takes you back for child support recalculation in SC, the Court will look at the incomes (and earning capacities) of both parties when calculating the child support obligation.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
