Legal Question in Family Law in South Carolina

I am divorced. My ex has custody of our 10 yr old and 13 yr old. He has kicked, pinched, slapped the head, ridiculed, said abusive things. My girls want to live with me. He is also abusive towards me. I am unemployed and so is he. He gets retirement I'm supposed to get half but I don't have $$ to spend on lawyer to take him to court to get it. How do I get my girls and my 1/2 of retirement? Can my 13 yr old just move in with me?

thanks Beth

If the Order says that he has custody, then you could be held in contempt if the child(ren) simply move in with you. If you believe that you can show that he poses a threat/danger to them, then you can certainly bring an action seeking to change custody to you.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
