Legal Question in Family Law in South Carolina

I divorced in November 2001 then remarried the same man in May 2002, but we didn't live together or consummate the remarriage. We have no property to divide or small children. Do we need to file for a divorce or is there an annulment that we can go through? Neither of us contest the the divorce and cannot afford legal fees.

It is my opinion that you have waited too long to get an annulment. The South Carolina judicial Department has a website with all of the forms you will need to obtain a divorce on your own. It will make it easier that your husband is not going to contest anything. Go to this website www.judicial.state.sc.us and there is a section at the bottom of the page that says "General Public," on the section you will see "SRL Divorce Packet." Click on this packet and you will find everything you need to get a simple uncontested divorce, including instructions. It is a great package. SRL stands for Self Represented Litigant. Good luck!
