Legal Question in Family Law in South Carolina

grounds for divorce

My husband has filled for divorce on the grounds of adultery. The court date is two days away. Now he's talking about reconciling. My question is, if we try to work things out and he drops the case will he be able to use the same grounds if our reconcilliation doesn't work. Will he be able to bring up the adultery charge again? How long would I have to stay with him to make the adultery charge void?

Re: grounds for divorce

If you truly reconcile, then you can use that as a defense if he tries to resurrect the adultery allegations against you in the future. There is no "magic" time limit of how long you must stay reconciled, only that you intend to resume your marital relationship, etc.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
