Legal Question in Family Law in South Carolina

separation finances/ living arrangements

Been married for 28 years. I am asking my husband for a divorce- tired of his running around. We have a son in college home in summer school. Can I ask husband to leave? Do I have the right to stay in the house?

Re: separation finances/ living arrangements

If you can prove his adultery, then you can ask him to leave and/or ask the Court to require him to leave. The Court will determine who stays in the house, but if he was at fault, your chances are good on that issue.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
