Legal Question in Civil Litigation in South Carolina

cat damage

We have a neighbor who is taking us to court for damages of 892.00 that she said our cat did to her porch. She wants us to replace the whole screen, door, shutters and slats. My cat weights 10 lbs, and has never damaged our own house and there are many other cats around. She has sued many people in our neigborhood and now it is our turn. How should we handle this

If your not interested in settling, which is doesn't sound like you are, then you will have to defend the law suit. Since she is the plaintiff, she is entitled to her day in court and will have the responsibility of proving her case. As the defendant, your responsibility is to defend the case. Since she is only suing for $892.00, I assume this case is in Magistrate Court. That court has less stringent rules and procedures than State court. Sometimes people can handle the trial themselves. However, your best bet would be to have an attorney represent you. Without knowing more about the case, my advise would be to go see an attorney who can review the Complaint, extract all the necessary details and give you his/her opinion. Good luck.
