Agent's liability in a fudiciary agency

Family Business. Insurance Agent off and on for many years. Our Insurance contact ( My mother) suffering (unknow to all) a catistrophic disease of the brain. Agent did not notify our company of cancellation. In the past, we did not receive our policy's for at least three months after the start date. Had wreak. Contacted Ins. Agent. Have recording of agent saying company would cover up to $25.000. Then personnel injury claims. (Have files from ins. companines and what was filed under their non-insured motorist protection. Did not exceed $25,000)

Ins. Company acted as our representative up to this time. Then Dropped us. Talked with agent one week before accident and never mentioned no coverage only interested in Workman's Comp. figures for insurance rates. My mother died. Insurance company renewed our policy and we even paid the toal for the year before. Agent suggested ignoring any and all correspondence. Noe being sued.

I'm not completely sure what your question is. I assume that the insurance company is taking the position that you had no insurance and you feel that they did't properly notitfy you.
