auto accident insurance settlement

I was hit in the back by a semi, and I was driving a vw jetta. The guy's insurance company is pushing for us to sign a release of property damage before we can get our car. Is this right? I also have medical bills outstanding, rental car issues, and depreciation of our vehicle estimates still in the air. So do we sign to get our car, or can we get our car without signing?

It depends on whether you are satisfied with what they are offering you. Here in SC you have two law suits. One is for property damage and one is for personal injury. When I handle these cases I always make sure that the property damage settlement is fair or I lump it into the personal injury claim and that usually gets the insurance company to make a reasonable offer. As long as you are settling the property damage for what is fair, then its okay to settle. But do not settle prior to getting your car.
