insurance claim denied

My husband struck a cow in the highway. He totalled his truck and had to go to the emergency room to have his foot x-rayed. We were told that the owners of the cow are not liable for any of this because they had the proper fencing to keep the cows in. How can they not be liable when it was their cow in the highway? We are without a vehicle and have medical bills for an accident that was not our fault. The insurance co. told us we would have to file on our insurance and they couldn't guarantee that it wouldn't make our insurance go up. How can this be right?

Who told you that the owners of the cow were not liable? Let me guess, it was the cow owner or the insurance company for the cow owner. Don't believe it. You can file a claim against them for all of your medical bills and property damage to the car. This must be done a certain way. You are free to call and I can advise you from there. Robert Johnston.
