Legal Question in Personal Injury in South Carolina

My husband was severely injured when a tree limb hit the cherry picker that he was in,and the cherry picker slammed to the ground. He was in up in the air approximately 50 feet. He was hospitalized for fourteen days. The insurance company for the truck states it is not a covered loss because the driver did not cause the accident, the tree limb did. Is this correct?

Sounds fishy but it also sounds like this is a workers compensation matter. Did your husband file with his employer's workers comp carrier?
