Legal Question in Personal Injury in South Carolina

From a recent auto accident, the at fault party's insurance issued me 2 checks. Now they are saying they need repayment for one of the checks. They say they made a mistake in issuing the two different checks, which were for completely different amounts. Do I have to pay it back?

1) Yes, if you knew that there was a mistake. 2) Probably if the payment exceeded your damages. 3) No if you did not know that there was a mistake and the payment did not exceed your damages.
