How would I proceed in taking the person already charged & found guilty of asssault in magistrate court to another court to get compensated fo pain & suffering, as well as doc. bills being paid? Would this be a civil suit? She was given a fine & I was just advised that I would have to take another route in order to get what I mentioned above. Please let me know what action I can take to be able to know my rights would help a great deal .

You can file a civil suit against her for Assault and Battery. If you sue her for $7,500.00 or less you would do it in Magistrates Court, which is a county court. If you sue for more than that, it would be in the Court of Common Pleas, which is State Circuit court.
