Legal Question in Traffic Law in South Carolina

Ticket for Suspended License

I have a friend that recently got a ticket in SC for driving with a suspended license. She knew that her license had been suspended, but thought that it had been taken care of. She has already had her court date, she was found guilty and they did not reduce the fine at all. It is a large sum of money. She had gotten a speeding ticket in Orangeburg County earlier in the year and they were supposed to send her a release form that she was supposed to take to the DMV to have her license unsuspended. She never got it... After her court date, they fianlly sent the form to her after she figured out that the form was all that she was missing. She has not yet paid the ticket. She has the paper trail of all of the payments that she has made. Is there some way that this can be fought since it was an error in Orangeburg?

Re: Ticket for Suspended License

Had she asked this question prior to being found guilty, then an attorney could have explained the situation to the prosecutor and maybe something could have been done to help her. Unfortunately, its probably too late for that. If she has been found guilty then its over with. There is a way to appeal it, but not for the reason you have explained. Good luck.
