Legal Question in Consumer Law in South Dakota

Tenant/Landlord

My husband and I have been renting for a year while finding a house to buy. Our lease is up at the end of this month, and our realtor just infomred us yesterday that an offer we put on a house was accepted but that the sellers need to close this month. So I called the landlord to let him know that we would indeed be moving out at the end of the month and wouldn't pursue a month to month lease. I also, per his request, left a written note explaining the same in the rent drop box. The lease says we must give a full months notice before moving out. We gave notice on the first (so basically we were one day late in his mind), so he's saying if he can't find someone to move in on the first of September he will charge us for that month even though our lease is up at the end of this month. Do we have any legal recourse to make sure our security deposit, which is rather large, does not get put towards paying rent for next month if no tenant is found.

No.unless you can successfully assist your LL is getting it rented, you will be on the hook.

I would BUY your LL a large FOR RENT sign, fully assist in showing it, and pay for ADS online and in the largest local paper IMMEDIATELY..
