Legal Question in Criminal Law in South Dakota

Possession

I have recently been quiestioned by an investigator. He states, our WebTv has been used to purchase child porn. We have run across this stuff, but never purchased it. With webtv we cannot down load or keep anything on file. He says, possesion can be if they find anything with a wearch warrant at microsoft on our files. Microsoft says they don't keep records back to 98 or 99.

We are at wits end, how can they prosecute us for possession of something we don't have, or would not have access too?

If you don't have legal representation you should obtain such immediately. You are speaking of serious charges which carry serious jail time. This is definitely not do-it-yourself. Do NOT speak to anyone about this in any fashion until you have a lawyer. You don't know what they have. Until you do, remain silent and obtain legal representation ASAP.
