Legal Question in Intellectual Property in South Dakota

What is legal to videotape and sell?

I want to produce a video guide to my favorite theme park. How can I avoid running into legal problems with the park management? Is it enough to not include trademarked signs and logos?

Re: What is legal to videotape and sell?

Have you approached the park managment? Have they told you you're not allowed to film? You might want to check with them and find out if they will give you a waiver to film or if not, how much they want for you to use their logo and such. The other part of this is that you have a right to use some items under the fair use doctrine.

To do this right, I wouldn't rely on just my word, I would urge you to speak to an attorney who works in the IP field. IF you do not know one in your home area, please contact your state Bar or the American Bar Association or try to find one on Findlaw.com or AVVO.com

Good luck
