Legal Question in Landlord & Tenant Law in Spain

She wont leave my home!

I own a property in Malaga, Spain and have rented it out to a woman with 2 kids. Her lease is finished on March 1st 2007, however she is saying she is not leaving. She states that because she has kids we can not throw her out! Could you claify the position please.

Hello,

First of all, it doesn't whether she has children or not, it's not important.

As for your right to throw away your tenant your contract shall be checked by a lawyer. Questions like if you are going to use the property for yourself or for how long has she rented are very important.

One thing, if she's rented for less than five years, it will be difficult to make her leave your house.
