Legal Question in Bankruptcy in Tennessee

Chapter 7 Bankrupcy

I am filing Chapter 7 during a divorce. The mortgage to the house is in my husband's name only. I am on the deed. Will the house be tied up in my personal bankrupcy? Since all the credit cards are in my name (he removed himself as secondary user)will the creditors go after him?

Re: Chapter 7 Bankrupcy

It is unlikely that the house will get tied up in the Chapter 7 and it is also unlikely that the creditors will go after your husband after the discharge. However, the latter depends on the exact nature of the agreement and it is impossible to give an exact opinion without reviewing the contract language. You should consult with your bankruptcy attorney in regards to these matters.
