Legal Question in Civil Rights Law in Tennessee

Singled out and Humiliated

I am an automobile salesperson. I have been employed for approximately 14 months at this particular dealership. This past month a new sales manager was hired. I have gained about 20 lbs. since I started working there, so Im about 20 lbs. overweight. Im 6 ft. tall. Last week, he pulled me into his office and told me that I needed to get out and get some exercise because my appearance was a large part of my job. I am definitely not the only salesperson who is overweight. In fact the used car manager is about 40 lbs. overweight and three other salespersons are larger than I am. Do I have any recourse??

Re: Singled out and Humiliated

Your inquiry is a bit premature. The new sales manager has singled you out, but has done nothing more. Until you are dismissed, you have no actionable claim. Show him, in the meantime, that your weight is of no significance in the successful performance of your job. You need to change his perception, more than assert rights, at this point.
