Legal Question in Credit and Debt Law in Tennessee

small claims procedure

I own a corporation in Tennessee. Do I have to hire a lawyer to represent me in Small Claim Court? I am from CAlifornia and in that State, a non laywer, even a corporation could appear without counsel, in small claims court only. As a matter of fact, in California, a lawyer cannot represent a party at all - it is limited to parties only.

I cannot find Tennessee law on point and I want to handle my own cases in Small Claims if possible to save money.

In general sessions court in Tennessee, you must have an attorney to represent a corporation. The reason being that Tennessee general sessions courts are not your typical small claims courts, but share many of the same qualities (e.g., follow rules of evidence) as the typical state trial courts. Because of this, if a lay person attempts to represent a corporation in general sessions court, the judge will not permit it.
