TN Lawyer (Lie Detector Test & Breach Of Contract??)

A Chattanooga TN lawyer told a friend who was charged with stealing $56 from a vending machine business that he could take two Lie detector tests. He said that the first one would not count and that it would just be used to familarize him with the process. My friend (call him Bob) failed the first test and was never given another chance. The lawyer basicaly allowed the first test to be admitted and consequently (Bob) was told that he had to sign an agreement to pay the owner of the business over $1,000.00. Is this a breach of contract? Is there anything that can be done to give (Bob) another chance?
