Legal Question in Discrimination Law in Tennessee

Harrasment on the job from another employee.

I have been working at my job for over a year and a half. I work with a woman there that has been harrasing me there for over a year. I called our corporate headquarters and talked to the person who was over the harrasment department, which in turn my district manager spoke to the woman. The second time she verbally harrased me I called corporate again! My district manager once more spoke to the woman and me in a little conference. Well to say the least the woman has once more harrased me on the job and I'm very tired of it. she has not been repremended for her actions and has not been apologetic. I have missed days from work because of this woman. What legal advice can you give, because obviously our corporate headquarters can't do anything?

Re: Harrasment on the job from another employee.

What type of harassment? If it is sexual in nature, you can sue for a hostile working environment. You can force them to discipline her or move her out of your area. If you have physical or emotional damages they may be liable for them up to a point, damages for such claims are capped under the Federal Act, but are not capped under the Tennessee Human Rights Act. You may also be entitled to punitive damages under certain circumstances. (Punitive damages are hard to come by in Tennessee.)

I hope this helps. Please feel free to contact me if you need more information, [email protected], 800.403.7868 or see my website, americanworkrights.com.
