Legal Question in DUI Law in Tennessee

settling a dui case without guilt

my friend was charged with a dui in Red Bank, TN for not taking a breathalizer test. She has a previous DUI from her college days in memphis, tn 9 years ago. She is a radiology technician and lives 35 miles from her place of employment and lives alone. people make mistakes and sometimes they need a break for what they have done. Could she settle this case by speaking to the judge and have a discussion with him about the consequences that this charge would bring, loss of radiology certification, career employment, home, car, etc. She is in her 30's and I think she can reason with the judge that this would ruin her entire life and could she not volunteer her skills as a radiology tech to the city, county, or state and be put on probation without a charge of DUI?

Re: settling a dui case without guilt

What county is her case filed in? When you are faced with a second DUI you never handle it without an atty. She is facing at least 45 days in jail and loss of her license for two years with the ability to get a restricted after one year. An atty may be able to negotiate because the 2nd comes after nine years. AN atty can examine the video to see if it was a proper stop. Please don't let your friend handle this on her own.
