17 yr old step-daughter wants to live with step-dad but mom and step-dad are div

My 17 yr old step-daughter wants to live with us,( she is my husbands step-daughter, with no custody rights) she is visiting for the summer, with mothers consent, however does not want to go home due to problems with mothers new boyfriend kicking her out twice as well as many other things. She will be eightteen in March, which is 8 months away, legally can she stay with us? Any help would be appreciated, thank you in advance!

Unfortunately you have not provided enough information. Please clarify by stating where the mother lives and where the last order dealing with custody was entered.
