Legal Question in Family Law in Tennessee

Custodial Parent Refuses to Allow the Child to come home

My ex husband has custody of our 16 year old son (in the state of Tennessee), however, my son has lived with me (in Michigan) for the last 4 years. My son is completely out of control and I am getting no assistance throught the court system because I do not have custody. My ex is refusing to allow him to move back in with him. Doesn't he have to assume responsibility and allow him to come back?

You need to review your divorce decree and see what it says about custody. If your ex-husband is designated as having custody in the decree, then he may be in contempt of a court order.
