Legal Question in Family Law in Tennessee

equitable distribution of marital assets

i would like a response to my submission from a practical rather than a theoretical basis:

when the court decides what equitable ditribution of marital assets is to be, what are the mandatory factors [if any] for consideration in a no-fault divorce and how is the decision affected should one partner have contributed much greater to their joint assets?

Re: equitable distribution of marital assets

If you are getting a "no-fault" or more technically an "irreconcilable differences" divorce in Tennessee, you are required to also prepare and submit a Marital Dissolution Agreement in which you and your spouse work out ALL terms of the divroce, including the division of all mariatl assets.

In other words the answer to your question is that there are NO factors the court considers in a true "no fault" divorce, because you and your spouse will already have divided things by agreement between yourselves.
