Definition of regulary employs 50 employees

What exactly does "regularly employs 50 employees" mean? Is it that a company has to keep atleast 50 employees on the payroll or does it mean that the company has to employee at least 50 employees in a 12-month period(current year)? If it is the latter would a cumulative total be kept on current employees and terminated, or just current?

50 OR MORE EMPLOYEES FOR 20 OR MORE WEEKS

Covered employers have 50 or more employees in 20 or more weeks during the year the leave is sought or the preceding year

FMLA applies to 50 employees within a 75 mile radius. If this criteria is satisfied, you may be entited to federal FMLA leave. I am not licensed in your state yet. So, I can't advise you on any state claims you may have. Contact a lawyer immediately. If you have trouble finding one, just yell.
