Legal Question in Medical Leave in Tennessee

i have severe sleep apnea high blood pressure high blood pressure and am borderline diabetic. i am 56 years old and my employer cn railroad wants me to work at least 60 hours per week. i am also on lexapro. i am getting to the point where i cant mentally or physically do this. i have 3.5 years to work i can make it 5 days per week but the 6th day is unbearable. can i be covered under FMLA.

The short answer is maybe.� You are covered by FMLA for your own serious health condition.� Serious health conditions are generally those which render you incapable of work for 3 consecutive days (although there are more details to it than that).� Additionally, you may have a chronic serious health condition which would entitle you to leave essentially, as your condition dictates.You need to gather together what medical information you have and sit down with an experienced labor and employment attorney to help guide you through these issues.� If you have any further questions, you can email me at [email protected].
