Legal Question in Landlord & Tenant Law in Tennessee

I'm a new Landlord - and have a huge ISSUE

My husband is military and we are currently stationed in VA. Our home was just built in june of 06. We made a trip to knox. on the 12th. A guy came to look at our home on the 13th and wanted it. He signed the lease, and gave us 2 checks, deposit and FEB. 1st months rent. On the 16th, we tried to cash the deposit check at our local bank,they would not cash it,it was written incorrectly.We called the tenant afterwards to notify him to send new checks.He said he would send us counter checks that afternoon.Friday 1/19 we had no checks.My husband called him and he said he mailed them out that morning.Yesterday 1/25/07 we still had no checks.We called him several times, no answer.I called his bank today and explained how the checks were written to see if they would have cashed them. I called back 3 times to speak to different reps to make sure I would have got the same answer.All 3 representatives from his bank said they would not have cashed it.I also had each rep. check to see if the funds were available.They were not. One rep even told me that the funds were not available today nor on the 13th.He already has the keys but isnt to move in till 2-1-07.We need to know if the lease is still good or void (no deposit)

It is really necessary to see the lease agreement,you may be able to send him a written notice that failure to provide certified check by overnight delivery will cause you to change the locks and void the lease.
